Terms of Service

Agreement

These draft Terms govern use of PhysioOS and the PhysioX backend, dashboard, APIs, GPT Actions, and MCP connector.

The service

PhysioOS provides personal training, nutrition, and body-composition tracking with persistent history and assistant-assisted coaching context.

It is consumer fitness and wellness software. Initial availability: United States only. It does not provide medical, clinical, or dietary-treatment services and is not a medical device.

No medical services

Nothing in PhysioOS is medical advice, diagnosis, treatment, cure, or clinical decision support.

Body-composition numbers you enter are consumer tracking data. Estimated SMM is an estimate and can move with hydration and glycogen. Water metrics are not a clinical diagnosis.

You are responsible for training safety, injuries, and whether you should consult a qualified professional.

Accounts

You must use your own account. Do not share passwords or connect an assistant to someone else's PhysioX account.

You are responsible for activity under your credentials. Keep your email reachable for password reset.

Acceptable use

Do not attempt to access another user's data, spoof user ids, abuse the API, or upload unlawful content.

Do not use PhysioOS to store medical records, payment-card data, or government identifiers. Do not submit protected health information if you are a health-care provider or covered entity; this product is not designed for those workflows.

Your content and data

You retain rights in the training notes, photos, and logs you submit. You grant us a limited license to host and process them to operate the service for you.

Permanent program changes and some nutrition-target changes persist only after you explicitly approve them.

Third-party services

ChatGPT / OpenAI, Anthropic / Claude, Google Drive, Google Health, Fitbit, Vercel, Neon, Resend, and USDA FoodData Central may process data as described in the Privacy Policy when you use those features.

Their terms apply to their services.

Availability and changes

The service may be unavailable, delayed, or changed. Features can be updated without notice.

Termination

You may stop using the service and delete a non-owner account from the Account page. We may suspend accounts that violate these terms or create a security risk.

Intellectual property

PhysioOS, PhysioX, and the product software and marks are owned by the operator. These terms do not transfer ownership.

Disclaimers and limitation of liability

THE SERVICE IS PROVIDED AS IS, WITHOUT WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR UNINTERRUPTED AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR TRAINING INJURIES ARISING FROM YOUR USE OF THE SERVICE.

Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Subject to any non-waivable consumer-protection rights, exclusive venue for disputes is the state or federal courts located in Texas.
